Legal Question in Family Law in New York

abandonment

I married an immigrant and he has still not received a green card, and I also have a three month daughter with him, now he is abandoning us.

What I would like to know is how can a court order against him be executed, and can he go around without obeying the court order. He is paying child support payment to me, but no alimony.

Thanking you in anticipation.

Regards.

Re: abandonment

I am sorry your marriage has ended badly. It is difficult to maintain a marriage among 2 people of the same backround, it is even more difficult when people are of different backrounds.

Regarding your question, it is good that you are receiving child support. About the alimony, I must first ask: what did the court order of divorce say about an award of alimony? The order is the first step in receiving alimony or support.

If he is not following a court order of support, then you have many options. You are welcome to discuss them with me.

You are welcome to a consultation for no fee at my offices at 42 west 44th street, NY,NY. Please call for an appointment first (646) 591-5786.
