Legal Question in Family Law in New York

Abandonment

I am a single dad, paying required support w/ 2 children (12 & 14) and never married (no court involvment). I live close to children and mother but new well paying job has put me on the road over 6 months a year. Mother is charging me with abandonment, and wants me to quit my job. I maintain a good relationship with my children a spend as much time with them as possible when home. What are my rights?

Re: Abandonment

As long as you contiue to pay child support and maintain a relationship with your children you are not doing anything illegal (or wrong). If you have a current visitation schedule and your new job prevents you from exercising that schedule, then you should have that modified by the court so that she does not file a violation of visitation petition.

Re: Abandonment

That is not considered legal abandonment of your children so don't quit your job for that reason.

Keep doing what you are doing, support them, keep in touch (cards/calls) and see them when you return.

If the Mother interferes with your rights when you return, go straight to Family Court and file a visitation petition.
