Legal Question in Family Law in New York
Help me
I was in an abuse relationship and finally found a way out of the hell I was living in.For the past few years I started to plan my get away so that I do not get hurt anymore. My husband is violent when he is drunk so I avoid him.I caught him cheating with some I know for 10 years and he father a child with another woman.Went to court and the judge was on his side. My husband claims that I do not live in the house and there is no proof. He claimed abondament. The judge said I am a person with dual personalities, does not believe that I was abused because I stayed married for 14 years. Also mentioned if my story showed on TV no one will watches it because it sounded ridiculous and if I write a book no one will buy it becuase it makes no sense. In addition, the judge had a stenographer and for mine he did not.The judge called me said many hurtful things and my lawyer did not stand up for me. Was he suppose to put a stop and request a stenographer? What do I do about the judge? My case is still pending and also I need to find another lawyer. But what about the money I paid to the lawyer already? My husband cleaned out our bank account and I am borrowing money for my divorce.I desparately need help. Who do I trust? Can you help me?

Re: Help me
This is a difficult situation. Judges can often be, well, not what they should be. I, as a member of the legal community, apologize for your rude and hurtful treatment from this person.
You should have a court reporter at all court appearances. Your lawyer can request one. It is likely that it is a good idea to have one.
It is a bad idea for your lawyer to talkj back to the judge. That may make matters worse. But a record should be made.
If you are the one petitioning for divorce, then you can withdraw the petition and you will get a different judge when you re-file.
The reason for the divorce is unimportant. If both of you (or really, one of you) wants to be divorced, then the reason is unimportant in todays world. The judge will not look into the reason.
