Accessing a jointly owned residence

My husband left our home six weeks ago. He lived in hotel for a four week period until his apartment became available. He has not been in ''our'' house since he left. He is now stating that he is bringing a police officer/sherrif to the house so that he can ''take what he wants.'' What recourse do I have, if any, to keep him out of the house? His name is on the mortgage and no papers (separation or divorce) have been filed yet.

Until you have a court order to keep him out of the home, your rights are limited. You should contact an attorney to discuss your options including starting a divorce action to secure what ever rights you may have.
