Legal Question in Family Law in New York

Active duty vs. Reserves

I understand child support is discontinued with active military enlistment. Does this also apply with going into the reserves?

Re: Active duty vs. Reserves

Military personnel (whether regular or Reserves), are primarily subject to Federal jurisdiction, rather than State Court jurisdiction.

However, Military service DOES NOT relieve a parent of child support payments or obligations.

Children and spouses of military personnel are entitled to receive an "Allotment" per the military parent's status and pay grade, with or in lieu of an employee wage garnishment.

Which is handled through the specific Military/Reserve Personnel or Legal office.

Any interested person may contact the Base Command Information Office for questions or direction regarding the process.

Good luck,
