adoption

i adopted a child. can my boyfriend adopt the same child,he is single, i am married to someone else in name only. we both did not adopt her at the same time we were advised to have him adopt later. i want him to adopt her so if something happens to me she has a dad.were trying to fill paper work out ourselves it looks like i would have to give her up in order for him to adopt her we do not want that

Contact the relevant state agency and get the form clarified. If you can't legally adopt, then you can always commit yourselves to care for her if either of you should die. Trusts and other financial arrangements can serve you well. Or have an attorney handle this for you and give you all your options.
