adoption

i was married to my husband (seperated but not leagally) when when my son was born and concieved from a short term

relation ship my husband and i are now back together we have four children together, the father of my son does not have contact with the baby now 20 mths old and paternity has never been established do i need the biological fathers

permision for my husband to adopt my son (i know ny law automatically considers him the father ) but the biological father can pursue paternity at any given time until age 18

Yes, you need his consent. However, if he is not interested in contact with the child, tactful maneuvers may produce his consent. Since you are entitled to child support from him, he may desire to escape that obligation by giving his consent. You may contact our office to discuss these issues in a consultation.
