Adoption of minor children by significant other when not married to said minor c

I have sole custody of my three minor children and am currently living with my boyfriend but not to be married for a while.. Can he legally adopt them for purposes of being able to add them to his medical insurance at his work? And what exactly would all be involved in us having him leagally adopt them?

Your boyfriend can legally adopt your children with your consent and with the birth father's consent. You will either need the birth father's consent or you will need to terminate his rights in court, unless that has already been done. I notice that you want your boyfriend to adopt your children for the "purpose of adding them to his medical insurance..." If that is your only reason for him adopting them then I would advise against going through the adoption process. If that is one of many reasons for this adoption then you should consult with an attorney and begin the process. By the way if you were married it would probably be easier as a step parent adoption rather than a non related adoption. By adopting the chidren, your boy friend would be come responsible for child support [if you were not living together] and would also be able to seek custody or visitation.

If you are not sure you want to marry him, then you should be very cautious about someone adopting your children.

If the problem is that you are still married, or that he is still married, suggest you try to get those issues resolved.

Then if you still wish to marry him, a step-parent adoption would not be very complicated.
