Legal Question in Family Law in New York
Adoption Question
I would like some information on how we would go about having my fiance adopt my daughter once we are legally married. Her 'bio' father left when I was 2 months pregnant, he has never seen her, his name is not on the birth certificate and he has no problems signing over his parental rights.

Re: Adoption Question
Once you are married, your fiance can begin the adoption process. It should not be difficult if the father signs over his rights. You would need a lawyer to file a petition for adoption, with various affidavits, there would have to be a home study, and then the adoption should go through. These types of adoptions in New York are handled by surrogates court.

I am an adoption attorney and would be happy to speak to you regarding your case. An adoption petition and various other documents and affidavits must be filed with the court. A homestudy must be completed by a licensed social worker. Please contact me at [email protected]
