Legal Question in Family Law in New York

adoptions

I have a 5yr old son, his father has not seen him since he was 3 days old. His father is not on the Birth Certificate and I have papers from his lawyer from when he was born telling me not to contact him or his family. Now I am engaged and my soon to be husband would like to adopt my son. I was told that he could sign the Birth Certificate and be done but I want to make sure that everything will be legal just incase the Bio father tries to come back into the picture. Thanks

Hi, I am an adoption attorney in New York. I would need more information to determine what if anything would need to be done regarding the birth father, but the process for your new husband to adopt your son requires more that just signing a birth certificate.
