Legal Question in Family Law in New York

how do adress the court to allow me to move to another state with my children? my court order says i can not take the children out of ny without permission from the state. the father has a founded case against him with child protective services. the court has been addressed again by me to make his visits supervised until father complies with the requests of cps. he has made attempt since jan. 2010 to see his kids or to take the classes required by cps. now he is violating me for not taking the kids to him. i asked the court months ago to supervise visitation and it took the court along time to find him. i have been dating a man from another state for a year and ahalf...the children and i all want to move to the other state to live with this wonderful man that we all love very much. how do get the court to listen to our appeal and make the kids and myself heard to the court. were not having much luck getting the court to listen to us and we go back to court in december. please help me....i cant afford an attorney on my minimum wage job and raising 3 kids alone with no child support being paid.

This all dependent on what's in your children's best interest; meaning, whether you have family residing in the new state; whether you have employment waiting; how will this move improve your lives, are just some factors the court will consider. Co-habitation as opposed to a new marriage is not a factor that the court will consider.
