Seeing another man is not considered adultry, having sexual relations with him is...even if divorce papers filed.

However, adultry is very difficult to prove and usually has nothing to do with issues of custody or equitable distribution. A threat used by many spouses. But it does tend to flare emotions and make for a messy, bitter and often protracted (expensive)divorce.
