Legal Question in Family Law in New York

my wife and i have differences of agreements so she left me and went to stay with her x boyfriend and his fiance in Tacoma WA. in Tacoma, Ft Lewis. The fiance left because she had too many arguments with my wife's x boyfriend and now my wife is pregnant with his child. I am still married to her with the expectation that she may come home. Now there is no chance and he is an enlisted man in teh military. What type of relief can I have since I am still married and my wife has a son from him over 4 years ago. I know that Adultry is a viloation of Article 134 in teh (UCMJ) uniform code of military justice. I want (besides a divorce) to make a formal complaint against him. and possible sue for the care of his child which he never cared for and I supported the child and my wife.

This must be very difficult for you.

The best way to proceed may be to file for divoce for reason of adultery (DRL 238(1))amd establish a legal foundation for your report to the military. The documents required for filing offer an opportunity to include his name in the facts cited to support the cause.

A divorce of this nature is usually not expensive and would take about 3 months.
