Legal Question in Family Law in New York

I need advice

I've been married 9 years now to a woman who came here from Equador. 1 yr after I was married to her, her brother wanted me to sign a paper to get her sons here. It seems like they want to get their whole family here. Her sons bought a house, and me and my wife moved in to the same house. I would argue with her sons about the way they would conduct themselves and soon found myself living in the garage (which is fixed up as an apartment). My wife lives in the main house, and I live in the garage. She comes into my apartment every once in a while and some times she's nice and sometimes she just wants to complain. I felt like moving out so many times but I don't realy have the money to move and If I did that they would probably give me a hard time when I do move out. I haven't had sex with her in awhile because I feel unconfortable with her, and I don't know if I realy trust her any more. She works occasionaly as an electronic assembler, but she lives in the main house which is owned by her son and she dosen't have to pay for food or rent. If I get divorced, will she be entitled to my car which I use to go to work with? (also she dosen't have a drivers license), and would I have to pay her maintenance? And why? and for how long?

It is unlikely that she will be entitled to your car if it was purchased before the marriage.

It is also unlikely that you will have to pay maintenance in light of the short duration of the marriage.

Finally, you should make decisions based on what is best for you in the long run. Make good long range decisions. Don't allow anticipated temporary difficulties stop you.

This would be a very simple divorce. It is possible that you would have an interest in the house, but no chance that your car would go to her. Look for a lawyer to help you draft the divorce documents.
