Legal Question in Family Law in New York
age of child determining visitation
My son lives with me & has regular visitations with his father every other weekend. His father and his step family do not treat him right & he doesn't wish to go there anymore. This is in NYS. What's the next step?

Re: age of child determining visitation
Assuming that your child is young (under the age of 13), you must re-assure your child and tell him why going to visit his father is a good thing.
It is more difficult to handle an older child. I would have a family meeting with the father and the child so the child can explain why he does not want visitation. Maybe it is a problem that can be fixed by the father. Maybe intervention by a social worker or other professional is needed.
