Legal Question in Family Law in New York

Alimony

My husband is suing me for divorce (although he left me). I will be filing for child support, but can I also file for maintenance (alimony)? Am I entitled to a portion of his 401K and Retirement benefits (he has been on his job over 10 years)? We have been married for 8 years.

Re: Alimony

I would strongly recommend that you consult with an attorney. Particularly if the assets are in the thousands of dollars.

It is likely that you will be entitled to all of the items that you mentioned. But again, you should consult with an attorney sooner rather than later.

Please feel free to call me for a free initial consultation at (718) 491-3345.
