Legal Question in Family Law in New York

Alimony

My mom's alimony of 30 years is being cut off due to declining health (dementia) on my father's part. He has many assets whereas mom has none. Do I need an elder care attorney or a divorce attorney? Also, dad lives in Upstate NY - mom in NJ - do I get an attorney in upstate NY too?

You need a matrimonial attorney in whatever area the original divorce case was brought.

Re: Alimony

It is necessary to file a motion under the divorce case in which she was granted alimony. You must file in the county where the divorce case was heard, whether it is in New York or New Jersey. If the case were heard in New Jersey I would be glad to be of assistance to your mother.
