Legal Question in Family Law in New York

Amending a divorce Agreement

If a divorce has already been finalized but both parties agree to an amendment of a part of that agreement (a change in the amount of life insurance required to be maintained), does this have to go back through the judge, or can it just be filed with the county clerk (therefore saving much time)?

Re: Amending a divorce Agreement

Filing the a stip with the clerk does not modify the order. Depending on the change, you might be able to run it by the judge without making a formal application to amend/modify the order.
