Legal Question in Family Law in New York

annullment

How do I proceed with an annullment? I already have a prenuptial and legal custody of our two children. I just want to file paperwork.

You have to follow court's procedure and you have to have strong reasons for annulment, unlike regular divorce.

An annulment is when there was no meeting of the minds when the marriage contract was entered into. This is because of misrepresentation, fraud, lack of competency or illegality.

An annulment will invalidate a prenuptial agreement. However, it is very difficult to prove, especially if there was full disclosure and the agreement was drafted by two lawyers.
