Legal Question in Family Law in New York

Annulment while I'm pregnant

My husband and I are currently expecting-I just found out that he never divorced his first wife when we got married abot 2 years ago. Does this mean we are not married?? Do I need to get an annullment?will this effect me from getting child support in the future? Please help!

Re: Annulment while I'm pregnant

If you were married and your husband never divorced his first wife, it means that you are not legally married.

If you want to stay with your husband, he must divorce his first wife and you must legally re-marry your husband.

If you do not want to stay with your husband you have grounds for an annulment. You will still be entitled to child support.
