right to appeal without retailation

a family court judge made a ruling and in his decision he said if I (the respondent) did a appeal of this case he would then give the father of the child custody. The purpose of the custody case was the safety of my daughter (age 2 now) I requested supervised Now---my current situation is my daughter has had injuries and came home with scabies I called child protection they said go back to family court. ....What do I do If I go to family court I may be before the same judge

A judge cannot take revenge because you appeal an order. Remember, you have only 30 days to file your notice of appeal.
