Legal Question in Family Law in New York

Appearing for a deposition if you are Very Very ill.

My dad is in the process of a contested divorce. He is the plaintiff. Since filing with the court he has become VERY VERY ill and has not been able to make 2 court appearances. Is there a way for him to give his deposition from a hospital? He is recouperating in Florida. The court is in NY

Yes. The deposition may be held in FL.

Either:

1. The attorneys would appear in Florida at the hospital (not a bad idea in the cold winter months). However, the clients will probably not pay for the trip.

2. More likely, you can have a telephone deposition. The attorneys would meet in NY with the stenographer. Your father would telephone the attorney's office and be placed on speaker telephone.
