Is it legal/ethical to audio tape therapy sessions if you are the client without the therapist permission or knowledge?

In New York, as long as one party to any conversation permits the taping, it is a legal tape. However, I am not sure what benefit you will find using the tape in court. If it is marital counseling and you feel your spouse will say something detrimental, then maybe it can help, but you open the pandora's box to all conversations and all tapes...Remember Watergate...
