Legal Question in Family Law in New York

I was just awarded custody of my son. His father has no intention on being in his life. Before i begin my divorce proceedings is there a way that I can waive my right to child support in New York?

Yes, it's possible. But no, it shouldn't be done.

Support is a right that goes to the child, not the parent. There are no circumstances under which it is to your advantage to waive support obligations.

I agree with David. And if you have custody, why are you waiving your right to support?
