Legal Question in Family Law in New York

Back Child Support Payments to Social Services

Paid child support before seperation or divorce papers were filed. Wife went on social services (rent, food stamps, etc) During this separation time child support was mailed to her. I have canceled money orders and recepts she signed. Social services is saying I have to pay for arrears in child support for when she went on public services. I was told all payments I made were not counted. Sent a check every 2 weeks for child support before she went to court. She cashed the checks shouldn't she be liable to reimburse social services for arrears if she accepted the monies and used it?

Re: Back Child Support Payments to Social Services

If I were you, I would get a local attorney. Having social services come after you for child support can have some serious consequences. A family law attorney will be familiar with these types of matters, and be able to fight the allegations.

You should definitely present your receipts to social services to show that you have paid child support. The problem is you are in a David and Goliath situation. You are David, and Social Services is Goliath. Social Services is used to people saying "I paid!" It may take some fighting to get them to give you credit for your payments.

I wish I could have given you better news!
