Legal Question in Family Law in New York

I am in the beginning of divorce proceedings and still have my husband living in the house. We have 2 children (one is special needs). My spouse has been verbally and emotionally abusive and controlling for years. This is the reason for my divorce request. He controls all money and is now telling me that I can not have my mother or sister around my kids because "they are too involved in their lives". We have always been very close with my mom and sister, but now he is insistingthat they not be allowed to come over or see my kids except at his approval. Is he allowed to do this. My attorney claims that I should just do as he says til the divorce sgreement is in place in court.

My children are very close with my family and this is really hurting them and the kids.

He is also refusing to pay my medical co pays for appointments that are necessary monthly visits for my health.. I do not work beacuse of the demands of my autistic child, and he has controlled all the money . He decides when and if I am entitled to it. As of now he is refusing to give me any money at all.

You should sit down with your attorney and demand answers that make sense to you. If he or she fails to answer the questions satisfactorily then and only then you should seek new counsel and discuss the situation. Changing attorney's in the middle of a case is not a good idea unless communication between you and the attorney has broken down or not started as you think it should.
