Legal Question in Family Law in New York
Ex behaving badly
Over the summer under my ex's care my 8 year old burnt his hand. My ex did call me but told me to go to one Hospital when he was at another. Said he lied because he didn't want any trouble. Last weekend my son called me from his house using my ex's cell phone. He was very upset because after he dialed my number the phone said ''dialing bitch.'' My ex's response to that was ''I told him not to use my cell phone.'' These are a few examples of his behavior. My question is can I and should I do anything legally about his behavior. And if so what? He only gets them 1 weekend a month right now as per his request. Any advice would be great. Thanks.

Re: Ex behaving badly
If you reasonably believe that your children are at risk when that are with their Father, you have an OBLIGATION to protect them by bringing a petition in Family Court to stop overnight visits and for supervised visitation.

You might consider filing a petition to modify the custody/visitation order, based upon a significant change in circumstances. Consult an attorney to evaluate this and other options.
