Legal Question in Family Law in New York

When someone is the beneficiary of a large sum of money that belongs to someone

My father died when I was 14years old, and left his brother in charge of the money that was to go to my university education. Instead of helping me out, my uncle did not give anything to me and now would not even take my calls. Please help give me some advice.

The terms of the Trust must be in the Will

Obtain a copy from the Surrogate's Court

where your parent died

If there is none, and only the oral promise

that the money would be so used, you are

probably out of luck

If there is a document, an accounting

proceeding can be brought in court, and

the trustee/relative held accountable

I would need to know more about how the money was disposed of. Was there a will? Was there a contract or any other document -- or was this purely verbal? Jeremy Morley

If your father left some type of trust, with your uncle as a trustee, you need to sue your uncle. If your uncle is not returning your calls, you need to retain an attorney. Your uncle may respond very quickly to an attorney, knowing he may be sued.
