Legal Question in Family Law in New York
Birth expenses 5 years later
My son was born 5/2000, I found out that my state insurance was dropped and did not cover birth expenses. My son's father was and is in the US Coast Guard, paternity was not legally established until our son was 9 months old. I am sure the birth of our child would have been covered by his insurance if he had taken care of it. Now the State has filed a judgement against me for the $18,000 (prior to accrued interest) I owe to the hospital. The DA's office told me they cannot pursue legal action against the father while he is in the military. Can I file a civil case against the father for part of this debt? What kind of attorney should I hire, and how much of the expenses is reasonable to request? Can the father be held responsible for the birth (c-section) and after care this late in time? Any help is appreciated.

This is a case I recommend pursuing. Once yopu establish paternity (not difficult even if he is in the military) then you can 'implead' him as a 'tortfeasor' and then the hospital can be directed to him for payment.
The military will cooperate in your efforts.
