Legal Question in Family Law in New York

Bitter Ex-Wife

My fiance's ex-wife (6 years now) has a drinking problem. She calls our house drunk (she has my fiance's 10 year old living with her now) to speak to her son (who we have had temp custody of for 7 months). She uses very abusive language when she speaks to me (I think she's still in love with my fiance) and we are really getting tired of it. Her kids have asked her to stop drinking and she refuses. Can we record those conversations and use them in order to get custody of the kids?

Re: Bitter Ex-Wife

Telephone conversations will not prove she is drinking.

However, there are other steps which can [and SHOULD] be taken now, to protect the child.

Without more facts it is not practical to advise you here.
