Legal Question in Family Law in New York

my boyfriend has been taking care of a baby for about 1 1/2 years. The mother disappeared for a few days and my boyfriend goes to family court for full custody . She shows up two weeks later saying that hes not the father and she just used him for money. turns out that the baby is really not his. The mother tested positive for drugs , Now the baby was placed in foster care is there a way to get her back . she deserves better, shes still our baby !!!

He will have to argue equitable estoppel. He may also want to be trained as a foster care parent with the eventual goal of adoption of the child. This is not an easy task - he will need a lawyer to do this.
