Legal Question in Family Law in New York

In my boyfriend's divorce papers, it states that he can claim his son on his tax returns as long as he is all caught up with his child support. If he was in the arrears in the end of 2009, but got it up to date by March 2010, does this still mean he can't claim his son? His wife claimed him the son even though the April 15th deadline was not reached yet. He has since paid it up and filed a petition against her for contempt. Does if he have a chance since the child support has been paid before the tax deadline? Thank you for your help
