Your question is vague. If one spouse refuses to have intercourse w/ the other who wants it, for no valid reason (illness, etc), for one year, this is grounds for divorce in NY as constructive abandonment. Hope that answered your inquiry.

If a spouser wrongfully and without consent withholds intercourse for more than 1 year it is grounds for constructive abandonment of the other spouse.

It is called constructive abandonment ,which after 1 year becomes the grounds for a divorce. If there is however a medical reason for these actions then that constitutes a defense. For more info you may contact my office @718-834-0087.

Withholding of sex from a spouse, without cause, and without the intention of resumption of sexual intimacy with the spouse, is Grounds for Divorce.
