Legal Question in Family Law in New York

In case of a relocation of the mother from NYC to Europe, does the mother need the approval from the father's child to relocate with her son. The mother and the father in this case are not married. What papers does the mother need to take the child legaly to Europe where she would like to stay for good with her child, being separated by the father.

Does the father visit with the child? If so, how often? Does he have a relationship with the child? These are all questions that need to be answered. While there is no order preventing you from taking the child to Europe, as a general rule the Family Court would have to allow you to relocate with the child, particularly if the father sees him and has a relationship with him. You should consult with a family law attorney who is well versed in these matters before taking any action on your own.
