Legal Question in Family Law in New York

Cash award_back child support

I am a single Mom raising 2 small children. I have been w/ my their father on & off for a few years during which time I have handled 80% of the financial responsibility. He is due to receive a large cash award from a lawsuit some time next year. How can I ensure that he takes care of his children w/o having to go to court? I want to keep the peace, but I want to make sure I don't get stiffed. I've been carrying the family for this long and since we are not married, am I only entitled to claiming Child Support? Please help. Thank you.

Absent an agreement, you will have to go to court.

Unfortunately, you may have to resort to court.

You can attempt to have him sign an agreement regarding child support, but I am not sure he would do such a thing.

Otherwise, you can take it to the Family Court Hearing Examiner in your county. You will need to fill out a petition. You should do this as soon as possible, before he spends the settlement monies.
