Legal Question in Family Law in New York
What is her chances?
I have had custody of my two boys from a previous relationship for nine years now, and my ex (thier step-mother we were together for 4 years) is taking me to court for custody of them. She has turned me in to children services three times and all three were unfounded and closed. I can't afford a lawyer and have been turned down for legal aid. I am fighting the case myself. My kids are 10 and 9 and they wish to stay with me. What are the chances she will get custody of them? please hurry if you can my court case is in April. Thank you for any help.

To get custody of your own children, you do not have to be the father of the year. The fact that you have custody now is a plus. However, no one can give you an intelligent answer, based on these limited facts.
Even though you cannot afford to have an attorney represent you, suggest you consult with an experienced matrimonial attorney who can advise you about how to proceed with the custody case on your own.
FYI - I practice in NYC and Long Island.

The test in Family Court is what is in the best interests of the children. If you cannot afford to hire an attorney, one option is you ask the court to appoint an attorney to represent the interests of the children. In some cases, that attorney can be paid for by county funds. I practice in NYC and the surrounding counties. Roland Acevedo (212) 371-4500
