Legal Question in Family Law in New York

Last name change & adoption

I recently gave birth to my daughter (6/22/08). Her father was there to sign the papers...however he is no longer around. He hasn't seen the baby since. My longtime female partner (I'm a bi-sexual woman) and I have decided to raise the baby together. She is currently a month old...I'd like to remove her fathers last name asap and file for an adoption bet me and my partner.

Re: Last name change & adoption

Since the father is listed on the birth certificate and he has been acknowledged by you as the father of your child, you are going to have to have his permission to allow your partner to adopt the child. Without his voluntary consent, you are out of luck in New York State or anyother state.
