Legal Question in Family Law in New York

Change of Judge

My stepdaughter has had an ongoing case in Suffolk County Family Court (visitation/custody by a grandparent). The case had been moved to another judge. We believe it was at the request of the opposing counsel. How do I find out why the Judge was changed originally? The current Judge is extremely unfair (we believe that there is a connnection between the judge and the plaintiff). How can she get the judge changed back or move the case to a different court? She also has no transportation and needs to have the case to be changed to a court closer to her home.

Re: Change of Judge

The court can be changed to a court closer to her home. This is done by a motion for 'change of venue'. These motions (if the facts supporting it are real) are usually granted.

If too much has happened on the case to this date (how many hearings have been held?) the court may decide that it is unfair to the taxpayer to start from the beginning.

Your daughter's current attorney can make the motion very easily. It is not complicated.
