Change the last name of a minor

I am trying to change my child's last name to reflect my last name. I am a single mom and although I was engaged to my child's father since his birth we have had nothing but negative contact with him. He is not listed on my child's birth certificate. Family Court sent me to Civil Court-Civil Court sent me back to Family Court. My grounds for the name change are valid-he does not support my son emotionally or financially and I have recently discovered that he may be using my son's name instead of his own in a criminal matter. What can I do to get this change completed?
