Name change for minor when father is fugitive and unavailable to consent

How can a mother of a minor child legally change the child's last name when the father is not in contact with the family, is a fugitive from the law and therefore cannot and/or will not give written consent? What is the legal process in New York State?

Depending on the age of the child this is not that difficult a procedure, basically uoi would have to apply to the court for aname change and submit an affidavit as to the reason, then you would publish notice. I would be happy to help you with this.
