Legal Question in Family Law in New York

name change for minor

The nature father of the child disappears over eight years. The mother has custodian right. She got marry with the nice man and last name changed due to the marriage. By New York Name Change for a minor, the application must be brought one of the minor's parent. Therefore the minor is able to change to the mother,s current family name?

P.S. The non-petition parent can not be served with reason notice of the apps( no one knows where he is).

He would have to be served by publication, with permission of the court. You would first have to show due diligence in attempting to locate him.
