Legal Question in Family Law in New York

If I change my name and move away and lose contact with my family, will they be notified if I pass away?

Also, if I have a child and am a single mother, and I want a certain friend to be guardian of my child if I die (in my will), would my family be notified of this as well? Could they take the child away from her even if she is capable of raising and giving this child what he needs?

Locksley Wade Law Office of Locksley O. Wade

The authorities will make an attempt to notify the next of kin if that information is available.

In response to your next question, the Courts may consider your wishes in a Will, however, they make a determination as to your child's guardian according to what is in the best interest of the child. Finally, family members have a first preference in custody cases unless there is somthing that would exclude them from having custody.
