name change

I am recieving child support payments for 2 children ages 17&13.No contact with father for 13 yrs.Child support comes from Puert Rico.Children have expressed desire to change last name to last name of stepfather of 12 yrs.Can this be done without compromising their child support?

Re: name change

Yes, by a petition for a court order, on notice to the father. Even if the father opposed [which seems unlikly], he would be hard pressed to explain to the judge why there was no contact with the children for 12 years.

What you do not want to occur is a termination of his parental rights.

Re: name change

The name of the children do not have anything to do with child support. A biological parent is responsible to support a child. You will have to go to court to get the name changed.
