Name change of son

I have complete custody of my six year old son, his father is in the process of taking me to court to get a visititaion schedule in place. I don't know how that will turn out but my question is; Can I change my son's last name to my married name? My son does want to and has even suggested a hyphenated name. Right now he has my maiden name but wants to be the same as everyone else. Do I need permission from his biological father?
