Name change for son
Regarding my son's name change question... He is 30 years old and I just got his birth certificate in August 2001 from New york.... It only has male as first name and an incorrect last name. He is getting married in a couple of months and needs to have a birth certificate with his correct/current name used for this 30 years which is his legal name. He has a baptismal certificate, drivers license, school records, immunization records all in his legal current name. The only problem is his birth certificate from New York is a mess.I did NOT know it was so incorrect until finally receiving it in the mail here in Penna. recently. I thought perhaps changing his name for birth certificate purpose would be quicker because he is getting married and he and his fiancee are a mess over this. It is MY fault for never following through with this since moving to PA in the 70's.
So. do I change name in PA or New York or doesn't it matter? His father is NOT around to help in this matter and since the need is so urgent thought perhaps this would be quicker, and at the suggestion of NY University clerk am following through on this since we only have a short time til his marriage.

I would suggest that you contact the vital records department in NY and see if there is a process to correct the birth certificate. He could Petition in the County where he lives to change his name, but I am not sure that will solve the problem. I would suggest that he contact an attorney in the county where he is residing. If he is in PA, I would be glad to discuss the options with him

While the situation is unfortunate, and an obvious mistake, you cannot change the name of a thirty year - old man, even if he is your son.
Only the adult in question, namely your son, can act to change his name. Suggest he confers with local counsel.
