Legal Question in Family Law in New York

changing a childs name

my estranged spouse to whom I am still married has changed the name of our minor son. I am not allowed any visitation by her and now am required to pay child support. I didn't agree to the name change and I still want to see and speak to my child. What are my rights as far as the name change and what can I do about visitation/custody?

You need to find out if was changed legally (in court). As for the custody/visitation you will need to file a petition in NYS if that's where the child lives. You are certainly entitled to visitation at least, unless there were incidents of abuse. You will need to hire a family law attorney to file the petition.
