Changing married to maiden name without divorce

I am a natural citizen of the U.S. I have resided in Chile since 1975 but will move to the U.S. (Arizona) during the year 2000. I was married in New York in 1971 prior to my move to Chile. I have been separated from my spouse for ten years but am not able to divorce under NYS law because I do not meet the 2 year residency requirement. I wish to recover my maiden name. Must I divorce before I can do this? If divorce is not necessary please advise me as to what I must do.

The residence requirement could also be satisfied if your husband lives in New York.
