Legal Question in Family Law in New York

Name Changing

I have sole custody of my nine year old daugther, she has no contact with her biologically father whats so ever, it has been seven years since there has been any kind of contact. My daugghter wants to change her last name to mine but I don't know if I need his permission to do so. Can you please let me know if I can change her last name without involving my ex- husband.

Re: Name Changing

You can petition the court and explain the circumstances, the judge would make a determination as to whether more documentation would be necessary. The other option is waiting till your child turns 18, then your daughter will not need anyone's permission to change her name.

Should you like to discuss this or any other legal matter, you can e-mail me for more information about low cost face-to-face, on-line, or a telephone consultation with a lawyer in our office.
