Legal Question in Family Law in New York

Changing Visitation Order

Due to my day job, I have been unable to visit Family Services here in Saratoga County, NY. I had originally (5 yrs ago) asked the court that my ex-husband have supervised visitation with our daughter due to some concerns I had at the time. Since then he has shown these concerns to be unfounded. I want to know if there is something that I can do to reverse the order without going back to court. Thank You in advance.

Re: Changing Visitation Order

An Order serves as protection when one of the parties is not,or does not want, to abide by its terms. So long as you and your ex agree, you can agree to follow any schedule which you desire. There are risks to proceeding without a modification to the Order, however. The best, and easiest way to modify the Order without having to appear in Court would be to prepare a Stipulation and Order and submit it to the Court for signature. An attorney could call the Court in advance to try to push the Stipulation and Order through without the need to appear in court.
