Legal Question in Family Law in New York
Child abandonment
5 years ago obtained divorce - cruel and unhumane treatment, 4 years ago remarried and moved to NC for jobs.
Daughter is currently 19, going to college full time - I have full custody. Father living in NY is filing for termination of his child support responsibilites due to abandonment. He does not call, visit, or email. Every time we are in the area(at least twice a year) it is the child who contacts him. She calls him usually once a month, sends CHristmas gifts - makes all efforts. I really cannot afford an attorney and since family court does not require one I hope to represent myself (hopefully via telephone) Suggestions Please!

Re: Child abandonment
So called "abandonment" is not a basis for terminating a child support obligation, but you or your ex- may be referring to some other "emancipation" event which would, in fact, warrant a termination of child support. Feel free to call me at 212-367-9167 to discuss this further. I do not charge a fee for the initial consultation.
